1. About Buraq Food App

Buraq Food Delivery App is an online multi-vendor food delivery platform operating in Pakistan.
We connect customers, independent food shops/restaurants, and delivery partners through our mobile application and website.

Buraq Food App does not own or operate food shops and does not prepare food.

2. Acceptance of Terms

By accessing or using Buraq Food App, you agree to comply with and be bound by these Terms & Conditions.
If you do not agree, please do not use the App.

3. Eligibility

  • Users must be 18 years or older

  • Users must have legal capacity under the laws of Pakistan

4. Platform Role & Marketplace Disclaimer

  • Buraq Food App acts only as a technology platform

  • Food shops are independent sellers

  • Delivery partners may be independent contractors

Buraq is not responsible for:

  • Food quality, taste, hygiene, or ingredients

  • Food safety violations by shops

  • Any allergic reactions or health issues

5. User Accounts

  • Accurate information is required for registration

  • Users are responsible for all activity on their account

  • OTPs and passwords must remain confidential

We may suspend or terminate accounts involved in misuse, abuse, or fraud.

6. Orders & Availability

  • All food items are listed by individual food shops

  • Order acceptance depends on shop availability

  • Shops may cancel orders due to stock issues, closing hours, or force majeure

Buraq reserves the right to cancel orders in case of:

  • Technical errors

  • Incorrect pricing

  • Suspected fraudulent activity

7. Pricing, Fees & Taxes

  • Prices are set by food shops

  • Delivery fees, service charges, and taxes may apply

  • Final payable amount is shown before checkout

Prices may vary between shops and locations.

8. Payments

Available payment methods may include:

  • Cash on Delivery (COD)

  • JazzCash / Easypaisa

  • Debit/Credit Cards

Buraq is not responsible for failures caused by third-party payment providers.

9. Cancellations & Refunds

  • Orders cannot be cancelled once preparation begins

  • Refund eligibility depends on:

    • Wrong item delivered

    • Order not delivered

    • Shop cancellation

Refunds are processed according to Buraq’s Refund Policy.
COD orders may not be refundable once delivered.

10. Delivery

  • Delivery times are estimates only

  • Delays may occur due to traffic, weather, or shop delays

  • Customers must be available at delivery location

Failure to receive an order may result in cancellation without refund.

11. Customer Responsibilities

Users agree to:

  • Provide correct address and contact details

  • Treat riders and shop staff respectfully

  • Avoid false complaints or misuse of refunds

Abusive behavior may result in account suspension.

12. Food Shop (Vendor) Responsibilities

Food shops are solely responsible for:

  • Food quality, freshness, and hygiene

  • Correct menu descriptions and pricing

  • Compliance with food laws of Pakistan

  • Handling customer complaints related to food

13. Delivery Partner Disclaimer

Delivery partners are responsible for:

  • Timely and safe delivery

  • Order handling during transit

Buraq is not liable for delays caused by external factors.

14. Limitation of Liability

To the extent permitted by Pakistani law:

  • Buraq shall not be liable for indirect or consequential damages

  • Liability is limited to the value of the affected order

15. Intellectual Property

All app content, logos, designs, and software belong to Buraq Food App.
Unauthorized use is strictly prohibited.

16. Privacy & Data Protection

User data is collected and processed according to our Privacy Policy and applicable Pakistani laws.

17. Termination

We may suspend or terminate access without notice if:

  • Terms are violated

  • Fraud or abuse is detected

  • Legal compliance requires it

18. Governing Law

These Terms are governed by the laws of the Islamic Republic of Pakistan.

19. Changes to Terms

We may update these Terms at any time. Continued use means acceptance of changes.
